Court of Appeal Ruling Throws Rivers APC Primaries Into Fresh Legal Uncertainty

The Rivers State chapter of the All Progressives Congress (APC) has been plunged into another legal and political crisis following a Court of Appeal decision in Port Harcourt concerning the party’s disputed congresses.

The appellate court upheld the effect of a Rivers State High Court decision concerning APC congresses that produced the Tony Okocha-led state executive. The dispute dates back to December 2024, when the High Court had issued an order restraining the party from proceeding with the congresses.

The congresses nevertheless went ahead, producing Okocha and other state executives. The matter subsequently reached the Court of Appeal.

Following the appellate ruling, the Emeka Beke-led faction of the Rivers APC argued that actions taken by the disputed executive—including nominations and other political decisions—were invalid. The faction consequently declared nominations arising from the party’s recently concluded primaries null and void.

However, the development should not be described as a new Supreme Court judgment nullifying the 2026 Rivers APC primaries. The relevant 2026 appellate ruling was delivered by the Court of Appeal, while the declaration against the primaries was made by the Beke-led faction of the Rivers APC.

The controversy is particularly significant ahead of the 2027 elections because the APC's ability to maintain a unified leadership structure and validly nominate candidates in Rivers State remains tied to the outcome of the continuing legal disputes.

The Rivers APC has also disputed some interpretations of the Court of Appeal judgment, maintaining that the ruling concerned particular congress-related proceedings and did not necessarily amount to the blanket removal of the Tony Okocha-led executive. The party said it was reviewing the certified judgment and considering its legal options.

The Rivers APC crisis therefore remains a developing legal matter, and claims that “the Supreme Court has just nullified the Rivers APC primaries” should not be published as an established fact without qualification.
